10^th Session of Competition Council of Bosnia and Herzegovina

PRESS RELEASE

Tenth session of Competition Council of Bosnia and Herzegovina was held on 2 March 2011, with following documents adopted: 

- Conclusion to dismiss Request for initiation of proceedings filed by undertaking Akt.online d.o.o. Sarajevo against undertaking BH Telecom d.d. Sarajevo, for the suspicion on existence of abuse of dominant position.

Competition Council dismissed Request for initiation of proceedings filed by undertaking Akt.online d.o.o. Sarajevo as anticipatory request. Undertaking Akt.online d.o.o. has brought an administrative dispute before the Court of Bosnia and Herzegovina against the Decision of Competition Council  No. 01-05-26-028-63-II/09. Since the administrative dispute is in progress, the conditions to review the filed Request have not been met yet.

- Conclusion on initiation of proceedings against the undertaking Telekomunikacije Republike Srpske a.d. Banja Luka, filed by the undertaking Crumb group d.o.o. Bijeljina,for determination of  presence of forbidden agreement, in terms of Article 4, paragraph (1) Item d)  and  for determination of  abuse of dominant position, in terms of Article 10, paragraph (2) Items

a), b), c) and d) of the Competition Act.

Competition Council has assessed that it is not possible to determine the allegations on infringement of Competition Act, stated in the Request, without the prior procedure, and decided to initiate the proceedings, after which it shall issue a final decision in terms of Article 42, within the deadline prescribed by Article 41 of the Act.
