CONCLUSIONS OF THE 31st SESSION OF THE COUNCIL OF COMPETITION OF BH

On 14.07.2006. the Council of Competition issued a Decision on allowed concentration between Bayerische Hypo-und-Vereinsbank AG (HVB), with the seat in Munich, Germany and UniCredito Italiano S.p.A (UCI), with the seat in Milan, Italy.

The Council of Competition got a notification on concentration from UniCredito Italiano S.p.A (UCI), on their intention to take control over Bayerische Hypo-und-Vereinsbank AG (HVB). The concentration of these two banks presents an exteritorial concentration, which significntly acts and affects the bank and financial market. European Comission has evaluated this concentration as allowable in European Union countries.

The bank and financial services in Bosnia and Herzegovna are affected through subsidiary asociations of the said banks: UniCredit Zagrebačka Banka d.d - Mostar, HVB Central Profit Banka d.d. - Sarajevo and Nova Banjalučka Banka - Banja Luka and through other subsidiary asociations and the persons conected to them.

Having the detailed legal and economic analysis, the Council of Competition has ascertained that, in spite of the increased market share of the parties to concentration, the concentration will not have negative affects to the bank and financial market of Bosnia and Herzegovina.

The Council of Competition initiates an assessment of the concentration between NLB Tuzlanske banke d.d. Tuzla and CBS Banke d.d Sarajevo.

During the assessment procedure, the Council of Competition will examine all facts of the concentration concerned and weather the parties to the concentration have satisfied the time limits on obligatory notification of the concentration.
