CONCLUSIONS OF THE 33rd SESSION OF THE COUNCIL OF COMPETITION

On 22 September 2006 the Council of Competition issued a Decision on compatible concentration between Privredna Banka Zagreb d.d (PBZ), headquartered in Zagreb, Republic of Croatia and LT Gospodarska bank d.d (LTG) , headquartered in Sarajevo, Bosnia and Herzegovina.

Privredna Banka Zagreb has submitted the notification on concentration intended by means of purchashing the shares of the LT Gospodarska bank to become a majority share-holder in it.

On the basis of the considered data and facts during the decision-making procedure the Council of Competition has ascertained that the intended concentration shall not have as effect the prevention, restriction and distortion of competition in the banking and financial market of Bosnia and Herzegovina and that it shall enhance the market competition in the banking services in Bosnia and Herzegovina.

The Council of Competition issued a fine in the amount of 75.000 KM on the Privredna Banka Zagreb because it failed to submit a notification on intended concentration within the period of time regulated by the Act on Competition.

The Council of Competition expressed the positiv opinion on a draft Act on subvention of the transportation expenses in the public transportation within the Sarajevo Canton area issued by the Ministry for work, social policy and displaced persons of Sarajevo Canton. The Council of Competition expressed a negative Opinion on a former draft Act because Article 6 was not in compliance with the Act on Competition. Ministry for work, social policy and displaced persons of Sarajevo Canton has changed the said Article 6 taking into account all objections of the Council of Competition stated in the former Opinion.

Upon the request submitted by the Regulatory Commission for Electric Power of Federation of Bosnia and Herzegovina (FERK) and the Regulatoty Commission for Electric Power of Republic of Srpska (REERS) the Council of Competition expresed the opinion that their Regulations on acquiring a status of the qualified buyer are harmonized with the provisions of the Act on Competition. By these Regulations the FERK and REERS shall enhence the indiscriminate behavour in the market of electric power in Federation of Bosnia and Herzegovina and in Republic of Srpska.
