CONCLUSIONS OF THE 34th
SESSION OF THE COUNCIL OF COMPETITION
SARAJEVO, 12 October 2006 - the Council of Competition in its 34th
session has issued a Decision where the concentration between
"MANN+HUMMEL" Auslandsbeteiligungsgesellschaft mbH, headquartered in
Ludwigsburg, Federal Republic of Germany and "UNICO FILTER" Tvornica
filtera (a filters factory) d.d. Tešanj is declared compatible.
The undertaking "MANN+HUMMEL" Auslandsbeteiligungsgesellschaft mbH
submitted to the Council of Competition a notification of
concentration intended by means of the purchasing the additional
stocks to achieve a control over the "UNICO FILTER" Tvornica filtera
d.d. Tešanj.
On the basis of the legal and economic analysis practiced during the
assessment procedure, the Council of Competition ascertaines that
the concentration in question will not have significant negative
effects in the market of Bosnia and Herzegovina.
At the same time, the concentration between BAR Laboratories Europe
B.V.i.o., Amsterdam, Netherlands and Pliva d.d., Zagreb, Croatia is
approved. The BAR Laboratories Europe B.V.i.o., Amsterdam,
Netherlands submits to the Council of Competition a notification of
concentration by means of which it intends to acquire a control over
the Pliva d.d., Zagreb, Croatia. BAR Laboratories Europe is a
subsidiary association which is under ownership of Barr
Pharmaceuticals, inc., New Jersey, USA, which deals mainly in
production and distribution of generic and their own pharmaceutical
products.
The concentation concerned affects the market of generic
pharmaceutical products in Bosnia and Herzegovina through the
subsidiary association Pliva d.o.o. Sarajevo, which participates in
the market of Bosnia and Herzegovina through its branches in
Sarajevo, Mostar and Banja Luka. On the basis of the facts
established in the decision-making procedure, the Council of
Competition has assessed that the intended concentration will not
effect infringement of rules of the competition in the market of
generic pharmaceutic products in Bosnia and Herzegovina.
