3rd  Session of Bosnia and Herzegovina  Council of Competition

 

PRESS RELEASE

 

Third session of the second assembly of Bosnia and Herzegovina Council of Competition was held in Sarajevo on 27 October 2010 with following documents adopted:

 

-          Decision upon Notification on intended concentration between the undertakings Atlantic Naložbe Ltd. Ljubljana and DROGA KOLINSKA d.d. Ljubljana.

Analyzing the relevant data, Council of Competition has found that the intended concentration shall not increase market participation, i.e. create or strengthen dominant position of the parties to the concentration.  This will certainly lead to a number of conveniences for consumers in Bosnia and Herzegovina, primarily regarding expansion of assortment of products, increase of quality and price reduction. In accordance with the above mentioned, Council of Competition has assessed the concentration as compatible.

-  Conclusion upon the notification of intended concentration between the undertakings Securitas AB, Sweden ad Alarm West Group d.o.o. Sarajevo, Bosnia and Herzegovina.

Council of Competition rejected the notification on intended concentration of the undertakings due to non-existence of obligation to notify in terms of Article 14, paragraph (1) of the Competition Act.

-          Two opinions upon the Request of the undertakings. One Opinion was issued upon the Request of Department for development, sports and culture of the Government of Brcko Dictrict of Bosnia and Herzegovina on the draft of Trade Law. 

Council of Competition determined that Draft Trade Law of Brcko Dictrict of Bosnia and Herzegovina does not comply with the Competition Act. Through the application of Trade Law of Brcko District, Government of Brcko Dictrict would create unlimited possibility to introduce market limitation measures that would consequently distort the market. In case of introduction of certain market limitations that would not exclude the competition, but enforce the limits necessary to achieve goals, this should be done within defined conditions and reasons, in order to prevent forbidden competition activities.
