CONCLUSIONS OF THE 45TH SESSION OF THE COUNCIL OF COMPETITION

SARAJEVO, 25 April 2007 - The Council of Competition issued in its 45th session a Resolution on dismissal of the Notification on intended concentration created between  Klas d.d. Sarajevo and Mlin „Husinski Rudar“ d.d. Ljubače Tuzla, due to non-existence of the obligation to notify the concentration pursuant to the stipulations of the Act on competition. On the basis of the preliminary analysis of the collected data, the Council of Competition established that no party to the concentration meets conditions necessary for notification of the concentration regarding the income level and joint market shares in the relevant market of Bosnia and Herzegovina. 

The Council of Competition has adopted a Resolution on dismissal  of the Notification of merger of undertaking „Eastman Kodak Health Group“, New York, USA and undertaking „Onex Corporation“ Toronto, Canada, due to non-existence of notification obligation stipulated under the Act on Competition. Namely, after the analysis of all data, it is established that no party needs to submit a notification on intended concentration because neither is registered in Bosnia and Herzegovina nor achieves through its activity total income which would have negative effect on the relevant market of Bosnia and Herzegovina.
