CONCLUSIONS OF THE 46TH SESSION OF THE COUNCIL OF COMPETITION

Sarajevo, 23 May 2007 - The Council of Competition issued a Resolution of dismissal of the Notification on intended concentration created between undertaking OAO "NeftegazInKor", Moscow, Federation of Russia and undertaking "Rafinerija ulja Modriča" a.d. Modriča due to non-existence of the obligation to notify the intended concentration pursuant to the stipulations of the Act on Competition. On the basis of analysis of collected data it was established that no party to the concentration meets stipulated conditions necessary for Notification of the concentration relating to totally achieved income in the worldwide market according to the final account in the year preceding the concentration.

The Council of Competition issued a Resolution of dismissal of the Notification on intended concentration created between undertaking OAO "NeftegazInKor", Moscow, Federation of Russia and undertaking "Rafinerija nafte"d.d. Bosanski Brod due to non-existence of the obligation to notify the intended concentration pursuant to the stipulations of the Act on Competition. On the basis of analysis of the data it was established that Notification of the concentration is not obligatory under the stipulations of the Act on competition because no conditions relating to totally achieved income in worldwide marked are satisfied.

The third Resolution of dismissal of the Notification on intended concentration between undertaking OAO "NeftegazInKor", Moscow, Federation of Russia and undertaking "Petrol" a.d. Banja Luka is issued due to the same reasons mentioned above.

The Council of Competition has adopted a Resolution on initiation of ex-officio proceedings for assessment of the concentration created between undertaking "Sarajevska pivara" d.d. Sarajevo and undertaking "Oslobođenje" d.d. Sarajevo. In the course of the procedure the Council of Competition will examine and analyze all relevant facts concerning the assessment of the concentration concerned, pursuant to the Act on Competition.
