CONCLUSIONS OF THE 52nd SESSION OF THE COUNCIL OF COMPETITION

Sarajevo, 23.10.2007. - On its 52nd session, the Council of Competition declared a concentration, which will be implemented in the insurance services market of Bosnia and Herzegovina between undertakings Krajina-Kopaonik from Istočnog (East) Sarajevo and Zavarovalnice Triglav d.d. from Ljubljana (Triglav), compatible. Triglav submitted to the Council of Competition a Notification on intended concentration by means of which it intends through purchase of majority stocks of undertaking Krajina-Kopaonik to become its majority owner. Krajina-Kopaonik acts in the services market in Republic of Srpska while undertaking Triglav acts just in the market of Federation of BIH through its subsidiary association Triglav BIH Osiguranje (Insurance )Sarajevo (which has a distribution and retail trade Network of its insurance products in the territory of Federation of BIH) . When the appraisal and analysis of the data and facts was completed, the Council of Competition assessed that the implementation of the concentration concerned will not distort a market competition in the insurance services market in BIH.

Upon the request of the Electricity Regulatory Agency in F BIH (FERK) the Council of Competition expressed its opinion about the Drafts Regulation on purchase/sales of electricity for 2008 between JP „Elektroprivreda BiH“ d.d. Sarajevo and JP „Elektroprivreda HZ HB“ d.d. Mostar. The Council of Competition considers that some regulations of the Regulation restrict the market competition. Namely, as the Decision stipulates the obligatory offering to the strictly selected buyer according to the previously determined tariffs, the Council of Competition supposes that adoption of this Regulation will distort market competition (the buyers are required to make obligatory purchase/sale of electricity in Federation BIH in 2008 -which is deemed to be restriction of competition).

At same time, upon the request of undertaking DELTA DMD d.o.o. Belgrade, Republic of Serbia, the Council of Competition expressed its opinion on the notification obligation of intended concentration to the Council of Competition, pursuant to the Act on Competition.
