CONCLUSIONS OF THE 53rd SESSION OF THE COUNCIL OF COMPETITION Sarajevo - 05 November 2007 - the Council of Competition on its 53rd session has refused a Request of the Sarajevo Canton Assembly for a delay in the implementation of the Decision of the Council of Competition by means of which the Assembly of Sarajevo Canton is instructed to change an Ordinance on adoption of Network of pharmaceutical practices-pharmacies in the Canton of Sarajevo. Namely , the Assembly of Sarajevo Canton submitted to the Council of Competition a request for a delay in the implementation of the Decision of the Council of Competition which was adopted upon request for initiation of the proceedings submitted by 15 private pharmacies against the Institute for Health Insurance of Sarajevo Canton and the Assembly of Sarajevo Canton by means of which the Assembly of Sarajevo Canton is instructed to change within the time period of six (6)months the Ordinance on adoption of Network of pharmaceutical practices-pharmacies in the Canton of Sarajevo. This Ordinance of Assembly of Sarajevo Canton has limited the number of pharmacies where the buyers can realize their right to get prescribed medicines falling within the burden on funds of the Institute by means of which the market competition is distorted. By means of this Decision the Sarajevo Canton Assembly is ordered to change the said Ordinance allowing all pharmacies, authorized for providing the pharmaceutical services, the same conditions to prescribe drugs to insured persons falling within the burden on funds of the Institute. The Council of Competition estimates that there is no legal condition to postpone the implementation of this Decision and therefore the Request of the Sarajevo Canton Assembly is rejected. |
