CONCLUSIONS OF THE 54th SESSION OF THE COUNCIL OF COMPETITION

Sarajevo, 22 November 2007 - The Council of Competition assessed, on its 54th session, that the concentration, implemented between undertakings Oslobođenje d.d. Sarajevo and Sarajevska pivara d.d. Sarajevo in the market for publication and distribution of daily newspapers and periodicals/magazines in Bosnia and Herzegovina, is compatible. 

The Council of Competition ascertained, on the basis to the publicly accessible information, that the concentration, implemented between Sarajevska pivara and Oslobođenje, was not notified to the Council of Competition pursuant to the Act on Competition. Therefore, the Council of Competition started ex-officio an assessment procedure of the concentration. After the analysis of all facts and information during the decision making procedure, the Council of Competition determined that Sarajevska pivara acquired a majority control over Oslobođenje through purchase majority of stocks of Oslobođenje company and that the concentration concerned have no negative effects on competition in the market for publication and distribution of daily newspapers and periodicals/magazine sin Bosnia and Herzegovina.  

Due to the fact that the Notification on intended concentration was not submitted pursuant to the Act on Competition, the Council of Competition imposed a fine to Sarajevska pivara in amount of 250.000,00 КМ. 

At same time, the Council of Competition expressed an opinion upon request of undertaking HOLDINA D.O.O. Sarajevo relating to its obligation to notify the intended concentration to the Council of Competition, pursuant to the Act on Competition.
