CONCLUSIONS OF THE 55th SESSION OF THE COUNCIL OF COMPETITION

SARAJEVO, 3 December 2007 - The Council of Competition declared the concentration which is created through acquisition of majority control of undertaking  Rio Tinto Plc, London, United Kingdoom of Great Brotain and North Ireland over undertaking Alcan Inc, Montreal, Canada, as compatible.  

Rio Tinto Plc submitted to the Council of Competition a Notification of intended concentration by means of which it intends to acquire majority control over Alcan Inc. Effects of the concentration on the market in Bosnia and Herzegovina are realized through  Preduzeća za geološka istraživanja i eksploatisanje ruda ( Company for geological survey and exploitation of minerals)  Rio Sava Mining d.o.o. Bijeljina, a subsidiary association, as a party to teh concentration. After the data  analysis the Council of Ciompetition established that implementation of the concentration shall not lead to distortion of the existing market competition in the market for bauxite processing and  exploitation and semiproducts and aluminium production and processing in Bosnia and Herzegovina. This concentration shall not change market shares of the parties to the concentration as only Rio Tinto Plc is presdent through its subsidiary association Rio Sava Mining d.o.o. Bijeljina in the market of Bosnia and Herzegovina. 

Also, upon request of the undertaking Društvo sa ograničenom odgovornošću za proizvodnju električne energije (the company of limited liability for electric power production ) EFT – Termoelektrana (Termal Power Plant)Stanari d.o.o. Stanari, the Council of Competition has expressed an opinion relating to the obligation of submission of the notification of intended concentration to the Council of Competition, pursuant to Act on Competition.
