CONCLUSIONS OF THE 60th SESSION OF THE COUNCIL OF COMPETITION SARAJEVO, 13 February 2008 - On its 60th session the Council of Competition has approved the concentration which will be created in the market for retail trade of groceries, food, drinks and wide range of household products in Federation of Bosnia and Herzegovina by taking a lease on a part of business premises owned by leaser- Gadžo Comerc d.o.o. Sarajevo to the lessee - Mercator BH d.o.o. Sarajevo. Mercator BH submitted to the Council of Competition a Notification of intended concentration by means of which it intends to takeover retail trade business of undertaking Gadžo Comerc . When complete all analysis, the Council of Competition assessed that this concentration will not significantly change market shares of the parties to the concentration and that it will not create or strengthen a dominant position of the parties to the concentration in the market. Also, the Council of Competition declared the concentration compatible; the concentration will be created in the market for retail trade of goods, food, drinks and wide range of household products in Federation of Bosnia and Herzegovina between undertakings Mercator BH d.o.o. Sarajevo and Omega d.o.o. Živinice. Mercator BH submitted to the Council of Competition a Notification of intended concentration intending to take a long term lease over business premises which belong to undertaking Omega d.o.o. Živinice. When completed all analysis, the Council of Competition assessed that this concentration would not have significantly negative effects in the market for retail trade of goods, food, deinks and wide range of household products in Federation of Bosnia and Herzegovina owing to the fact that the joined market share of the parties to the concentration was far below 40% (that is stipulated as a parameter for dominant position in the market). At same time, the Council of Competition has adopted a Resolution on initiation of the proceedings ex-officio against undertaking Centrotrans Eurolines d.d. – dioničarsko društvo za prevoz putnika u drumskom saobraćaju u privatnom vlasništvu Sarajevo(private stock company for road transportation of passengers) in order to determine violation of dominant position pursuant to stipulations of the Act on Competition. The Council of Competition established on the basis of data and information in its possession, the reasonable grounds for suspicion that the Act on Competition was abused by undertaking Centrotrans Eurolines d.d. Sarajevo. The Council of Competition will determine whether the system of sale of bus-tickets and service charge (payment for bus station services and insurance for passengers) at the counters of Bus station Sarajevo, owned by Centrotrans Eurolines d.d., puts some undertakings, dealing with transportation of passengers, in an unequal position towards Centrotrans Eurolines d.d. Sarajevo. |
