CONCLUSIONS OF THE 64th SESSION OF THE COUNCIL OF COMPETITION SARAJEVO, 20 March 2008 - upon the request of the Sarajevo Canton Assembly the Council of Competition expressed an opinion that Draft Decision on adoption of Network of pharmacies in Sarajevo Canton, the criteria, way and terms of negotiation with pharmacies have not been harmonized with the Act on Competition. The Council of Competition adopted, upon the request for initiation of the proceedings submitted by the 15 private pharmacies against the Health Insurance Institute of Sarajevo Canton and Assembly of Sarajevo Canton, a Decision of bond binding nature that proposes the Assembly of Sarajevo Canton to amend the Decision on adoption of Network of pharmaceutical activities /pharmacies in Sarajevo Canton within a period of six months. A Decision of the Assembly of Sarajevo Canton limits a number of pharmacies where insured persons can accomplish their rights to get prescription drugs falling within the burden on funds of the Institute and therefore distorts a market competition. The Assembly of Sarajevo Canton is ordered by means of the Decision to amend the Decision in question in a way to allow all pharmacies, registered to practice pharmaceutical activities, the prescription drugs practices and services under the equal conditions for insured persons falling within the burden of funds of the Health Insurance Institute. The stipulations of the Draft Decision on adoption of Network of pharmaceutical activities /pharmacies in Sarajevo Canton may not restrict, prevent or distort a market competition pursuant to the Act on Competition. It must allow all pharmacies, registered with the Ministry of Health of Sarajevo Canton to practice pharmaceutical activities, the prescription drugs practices for insured persons falling within the burden of funds of the Institute. |
