Sixth Session of Bosnia and Herzegovina Competition Council

PRESS RELEASE

6^th session of the second assembly of Bosnia and Herzegovina Competition Council was held in Sarajevo on 15 December 2010 with following documents adopted:

- Conclusion to dismiss the Notification of intended concentration of the undertakings „Klas“ d.d. Sarajevo, company for processing of cereals, flour, production of food and confectionary products, catering and tourism, foreign trade and retail and wholesale, and „Sprind“ d.d. Sarajevo, Sarajevska prehrambena industrija d.d.

Having and insight into submitted Notification and official documentation of Competition Council, it was established that Competition Council received Notification of intended concentration of the same undertakings on 12 August 2008, after which it reviewed the concentration as incompatible by Decision No: 01-06-26-033-65-II/08, of 6 April 2009 and imposed a fine on Klas and authorized person Mr. Vahid Pašović, Klas Director, for submitting incorrect and false information in concentration review procedure. Klas and authorized person Mr. Vahid Pašović, Klas Director, brought a dispute against the Decision of Competition Council before the Court of Bosnia and Herzegovina on 5 July 2010. Considering that administrative dispute before Court of Bosnia and Herzegovina is in progress, Competition Council dismissed the Notification as anticipatory request to review notification on concentration of these two undertakings.

- Conclusion to dismiss Request for initiation of procedure for violation of market competition, filed by undertaking „avaz – roto press“ d.o.o. Sarajevo against Stranka demokratske akcije Bosne i Hercegovine.

Having and insight into submitted Request, Competition Council determined that it does not have jurisdiction over the subject of the Request.

- Proposal of Decision on annexes and amendments of Decision on administrative tariffs regarding procedural matters before Competition Council.
