CONCLUSIONS OF THE 80TH SESSION OF THE COUNCIL OF COMPETITION

On 13th of January 2009, the 80th session of the Council of Competition was held in Sarajevo. The following had been achieved:

- The Decision was adopted defining that economic entity “ASA AUTO”, a limited liability company, Sarajevo, abused a dominant position in the market of the wholesale of the Volkswagen products to authorized dealers in Bosnia and Herzegovina, by restricting market and applying different conditions to the economic entity “M.R.M. export-import“, a limited liability company, Ljubuski, for the same or similar kind of activities than to other authorized dealers in BiH, within the meaning of Article 10 of the Law on Competition. For this abuse of dominant position, the economic entity “ASA AUTO” has been fined in the amount of KM 150,000 pursuant to the Law on Competition.

- The Decision was adopted assessing a concentration compatible in the market of providing cable distribution of radio and television program in municipalities of Prijedor, Banja Luka, Sanski Most which is to appear through acquiring control by purchasing basic assets of the economic entity „PROFEL – KOMUNIKACIJE“, a limited liability company for creating and servicing of communication systems, from the economic entity „ANEKS“, a limited liability company for engineering and consulting, Banja Luka. When analyzed the relevant data, the Council of Competition assessed that implementation of the intended concentration would not lead to creation of dominant position of the parties to the concentration, and would not lead towards prevention, restriction or distortion of market competition.

- The Conclusion was adopted rejecting the Notification of Concentration of economic entities “Delta Maxi“, a limited liability company for consumption goods trading, Banja Luka, and “C Market“ a.d. Banja Luka, for non-existence of concentration within the meaning of Article 12 of the Law on Competition.

- The Conclusion was adopted on initiation of the procedure on assessment of concentration compatibility of the economic entity Company for food grain and flour processing, production of food and confectionary products, hospitality industry and tourism, foreign trade and wholesale and retail trade “KLAS”, a joint stock company, Sarajevo, and economic entity “Sprind“ Sarajevo food processing industry.

- The Decision was adopted on concentartion compatibility of economic entities „Dukat mliječna industrija“, a joint stock company, Zagreb, and „KIM“, a joint stock company, Karlovac.
