CONCLUSIONS OF THE 81ST SESSION OF THE COUNCIL OF COMPETITION

On 27th of January 2009, the 81st session of the Council of Competition was held in Sarajevo. The following had been achieved:

- The Decision was adopted assessing a concentration compatible in the market of wholesale of printers in Bosnia and Herzegovina arising from acquiring a majority share in the basic capital of the economic entity CEEmark Ltd, Jersey, the Channel Islands, by the economic entity Lexmark International Technology, Genčve, Swiss Confederation. The concerned concentration is relevant for BiH as the economic entity CEEmark is 100% owner of the share in the basic capital of the economic entity CEEmark BH, Ltd Sarajevo. Through analysis of the relevant data, the Council of Competition of BiH has assessed in accordance with Article 17 of the Law on Competition of BiH that implementation of the intended concentration would not lead to creation of dominant position of the parties to the concentration in the relevant market or instigate prevention, restriction or distortion of completion in the concerned market.

- The Conclusion was adopted on ex oficio initiation of procedure for assessment of concentration within the meaning of relevant provisions of the Law on Competition between the economic entity Integral Inžinjering a.d. Laktaši, Banja Luka and economic entity Jedinstvo GP Gradiška, Gradiška.

- The Conclusion was adopted on initiation of procedure upon request of the Association of Independent Entrepreneurs Olovo against the Government of the Federation of BiH to define existence of prohibited agreement as defined in Article 4 of the Law on Competition.
