CONCLUSIONS OF the 85TH SESSION OF THE COUNCIL OF COMPETITION

IN SARAJEVO, on 16th March 2009, the 85th session of the Council of Competition of BiH was held. The following was adopted:

- Decision was adopted on concentration compatibility in the market of Internet services (dial up and broadband Internet) in the regions of Banja Luka and Prijedor and market of providing services of cable distribution of radio and TV programme in municipalities of Banja Luka, Laktaši, and Gradiška to appear after acquiring control by purchasing basic assets in the economic entity Company for engineering and trade of communication equipment and services KOMING – PRO Ltd. Gradiška by economic entity Aneks – Company for engineering and consulting export – import Ltd. Banja Luka. The Council of Competition assessed after evaluation and analysis of data and identified facts that implementation of the concerned concentration should not have impact on prevention, restriction or distortion of market competition in the relevant market of internet services provision. However, for submission of incorrect information in the concentration assessment procedure, economic entity Aneks Ltd. Banja Luka was fined in the amount of 10,000.00 KM and its responsible person Director Nebojša Antonijevic in the amount of 5.000,00 KM.

- Decision was adopted on concentration compatibility in the market of production and processing of wine, juices and other products in Bosnia and Herzegovina to appear through acquisition of control by purchasing majority of shares (67%) in the economic entity HEPOK joint stock company Mostar by the economic entity AMKO KOMERC Ltd. Sarajevo. According to Article 17 of the Law on Competition, the Council of Competition carried out analysis of positive and negative effects of the intended concentration, namely, it had taken into account all the relevant facts, and assessed that the concerned concentration does not create or strengthen dominant position in the relevant market of production and processing of wine, juices and other products in the territory of Bosnia and Herzegovina. However, for not submitting the Concentration Intention letter within the period prescribed by the Law, the Petitioner was fined in the amount of 100.000,00 KM.

- Decision was adopted on concentration compatibility in the market retail trade of consumption goods in Bosnia and Herzegovina to appear after acquisition of control by purchasing the majority share in the basic assets in the economic entity „DELTA MAXI“ trade of consumption goods Ltd. Banja Luka. After it had carried out data and identified facts analysis in the procedure upon request, the Council of Competition assessed that the concerned concentration should not have impact on prevention, restriction or distortion of competition in the relevant market of consumption goods trade in Bosnia and Herzegovina.
