8th Session of Competition Council of Bosnia and Herzegovina

PRESS RELEASE

 

Eighth session of Competition Council of Bosnia and Herzegovina was held on 9 February 2011, with following documents adopted: 

- Decision adopted upon Request for initiation of procedure, filed by undertakings Komunalije Hrgovčić d.o.o. Brčko distrikt, d.o.o. Čehajić Brčko distrikt, Obnova B d.o.o. Brčko distrikt, Gradska čistoća d.o.o. Brčko distrikt and d.o.o. Intermont against J.P. Komunalno Brčko d.o.o. Brčko distrikt. 

After the analysis of filed documentation, Competition Council has issued Decision, dismissing the Request of the undertakings, filed to determine the existence of banned agreement from the Article 4, paragraph (1) of the Competition Act, as ungrounded. Namely, undertaking „JP Komunalno“ through  its conduct on the relevant market, did not create any agreement with another undertaking that would have the goal to prevent, restrict or distort market competition. 

- Conclusion to extend the deadline for issuing Decision upon the Request for initiation of procedure against the undertakings  Radiotelevizija Federacije BiH, Pink BH Company d.o.o., Mreža plus d.o.o., OBN d.d., Hayat TV,  filed by the undertaking Radiotelevizija Bosne i Hercegovine.

Competition Council decided to extend the deadline for final decision for additional three months, in terms of Article 41, paragraph (2), due to need for additional analysis in order to determine factual state and review the proofs before issuing final decision.   

-          Opinion upon the Request of the undertaking Akt.online d.o.o. Sarajevo on assessment of competitiveness of prices for the termination of international traffic in the network of the undertaking  BH Telecom d.d. Sarajevo.

Analyzing the filed Request, Competition Council determined that it can not assess whether the prices for the termination of international traffic, offered by the undertaking BH Telecom d.d. Sarajevo to the alternative operators, are competitive to the prices BH Telecom d.d. Sarajevo offers to foreign operators for the same service. Since the undertaking Akt.online d.o.o. Sarajevo filed the Request for initiation of procedure due to suspicion on existence of abuse of dominant position in terms of Article 10 of the Competition Act, against BH Telecom d.d. Sarajevo, which also includes the issues stated in the Request for the opinion, Competition Council shall decide upon it in accordance with the Competition Act and other bylaws.
